Trademark Registration in Romania with OSIM and EUIPO

Your mark searched and filed at OSIM or the EUIPO for you, with every 2026 state fee and statutory term in view.

  • Filed at OSIM and the EUIPO under your power of attorney
  • OSIM, EUIPO or Madrid: the conditions set out
  • 2026 state fees itemised, in lei or euro
  • Protection for 10 years from filing, renewable

The brand the application will protect, in its real owner's name.

Protect the brand while the structure is being set

In Romania the right in a mark is acquired by registration at OSIM (Oficiul de Stat pentru Invenții și Mărci, the State Office for Inventions and Trademarks), and between two applicants the earlier filing wins. A founder preparing CASP authorisation with the ASF or our payment institution licence service can file before the brand goes public.

The owner can be the company formed through company formation in Romania. We file at OSIM or the EUIPO under your power of attorney; an OSIM-registered industrial property attorney represents where the law requires, and a Romanian lawyer gives opinions and drafts deeds. We are not a law firm.

What's included

Clearance search

OSIM's free register, TMview, WIPO Madrid Monitor and the trade register for company names, with a list of what we found.

The application in Romanian

Mark image, colour claim, translation of foreign words and a specific goods list by Nice class, prepared for your signature.

Fees in the right currency

Filing and publication fees paid before submission, so OSIM grants a filing date; lei for Romanian citizens and Romanian-law companies, euro for everyone else.

Filing at OSIM

Online, at the registry desk, by post or by e-mail, filed for you.

The attorney, coordinated

Where the law requires an OSIM-registered attorney after filing, we brief them and track the dates.

The EU route

We file the EUIPO application, basic fee within 1 month; after filing, an owner outside the EEA acts through a professional representative.

Where the service stops

No legal opinion or deed (a lawyer's work, Law 51/1995 art. 3), no tax advice, no promise of registration. Any sector authorisations after registration are a separate file.

Who owns the mark: founder, Romanian company or foreign parent

The owner's citizenship or the law governing the company sets the currency; its domicile, seat or real establishment sets the representation rule.

The owner's citizenship or governing law sets the currency, and its domicile or seat sets the representation rule.

The founder personally

Pays OSIM in euro unless a Romanian citizen; living outside the EU or EEA, every later step needs an OSIM-registered attorney.

The Romanian SRL

When the Romanian limited liability company owns the mark, it pays OSIM in lei and, seated in the EU, needs no compulsory representation.

The foreign parent or holding

Pays OSIM in euro and, outside the EEA, is represented after filing at both offices; an EEA company may use its own employee at the EUIPO. See the holding company page.

Which owner holds the mark also decides what moves in a sale; tax effects are your tax consultant's question.

OSIM, EUIPO or Madrid: the routes compared

Three routes; a first filing in a Paris Convention or WTO state opens 6 months' priority.

OSIM amounts from OG 41/1998 Annex 4, from 1 January 2026; EUIPO amounts from its fee page; Madrid membership (Law 5/1998) on OSIM's legislation page.

How trademark registration in Romania works

Who acts and each statutory term, per OSIM's filing guide. The rules and terms on this page are those of Law 84/1998 as republished in 2020; the law was republished again on 7 April 2026. OSIM's guide gives no typical processing time.

Documents you will need

  • The owner's full name and address, or the company's legal name and seat.
  • The mark in words; a gif or jpeg image if figurative.
  • Any colour claim: it changes the publication and examination fees.
  • A translation or transliteration of every foreign-language word.
  • A specific goods and services list by Nice class, 12th edition.
  • An e-mail address someone reads: OSIM notifies by e-mail.
  • Your power of attorney for the filing.
  • The earlier application and priority documents, if priority is claimed.

Problems we solve

A company name is not a trade mark

The name right comes from the trade register (Law 265/2022 art. 51) and clears no mark. We search both.

An owner outside the EU or EEA

Filing is open; every later OSIM step needs an OSIM-registered attorney, whom we coordinate.

A fee missed after filing

An unpaid examination fee means rejection, an unpaid certificate fee renunciation. We track both 30-day terms.

Renewal and use

Renewal opens 6 months before the 10-year date, or 6 months late at +50%. Five years without genuine use, and no good reason for it, opens revocation.

Selling or restructuring the company

An assignment needs a signed written deed. One the founder holds is not the company's (confirm with a lawyer): see what a buyer inherits with a ready-made Romanian SRL and our company changes service.

Selling the company, restructuring the group, or a renewal date coming up?

We list which marks sit with which owner and which terms are running, then prepare the OSIM requests for signature.

Why work with us

  • Bogdan Munteanu

Licensing and founder immigration lead, Bucharest. Romanian, English, Italian.

Where the matter needs an OSIM-registered attorney or a Romanian lawyer, we coordinate with the one you appoint, and we follow OSIM's 2026 filing guide and fee schedule.

From our practice

A filing first raises who owns the mark, whether the goods list is specific enough, and which currency applies.

Frequently asked questions about trademark registration in Romania

Can you file my trade mark at OSIM, and when is an attorney needed?

Yes. We prepare the application and file it at OSIM under your power of attorney. Representing you in the procedure is the work of an OSIM-registered industrial property attorney. For an owner with no domicile, seat or real, working establishment in the EU or EEA, it is compulsory in every step after the filing; we coordinate the attorney.

Do I need a Romanian industrial property attorney if my company is outside the EU?

Yes, for every OSIM step after the filing, if the company has no seat or real, working establishment in the EU or EEA. The filing itself does not need one. A Romanian SRL as owner is outside that rule. At the EUIPO, an owner outside the EEA is likewise represented in every proceeding except the filing.

Is my registered company name already protected as a trade mark?

No. The exclusive right to a company name comes from its entry in the trade register (Law 265/2022 art. 51), and it does not clear trade mark conflicts. Taking someone else's registered mark as a company name engages the applicant's liability. A name reservation and a trade mark search are two separate checks.

Why does this page show OSIM's fees but no total and no price for your work?

OSIM's fees depend on who the owner is (lei for Romanian citizens and Romanian-law companies, euro for others), any colour claim and the number of classes, so one total would mislead. A total without the 254 lei certificate fee misleads everyone: unpaid, the mark is treated as renounced. Our fee is on request, set by the route and the owner.

Can you guarantee my mark will be registered, and by when?

No. OSIM decides, and any third party may file observations or an opposition. The law sets OSIM's terms, such as a decision within 6 months of publication, and OSIM refunds its fees if it misses that term. OSIM's guide gives no typical processing time, so we work to the statutory terms and promise no date.

How do I register a trade mark in Romania?

Search OSIM's register, TMview and WIPO Madrid Monitor. File the Romanian application with the filing and publication fees already paid, then pay the examination fee within 30 days of filing. Answer any objection. After OSIM's notice that the procedure has ended, pay the 254 lei certificate fee within 30 days.

How long does trade mark registration in Romania take?

The law sets the terms: filing-date check and publication within 7 days each, observations for 2 months, a decision within 6 months of publication, opposition for 2 months after the admission is published, and the certificate fee within 30 days of OSIM's notice. OSIM's guide gives no typical processing time, so no total is promised.

What does OSIM charge in 2026, and do I pay in lei or euro?

For one class in black and white: filing 51 lei or EUR 10, publication 152 lei or EUR 30, examination 559 lei or EUR 110, certificate 254 lei or EUR 50 (OG 41/1998 Annex 4, from 1 January 2026). Romanian citizens and Romanian-law companies pay in lei, everyone else in euro.

Should I file with OSIM, the EUIPO or both?

The conditions differ. An OSIM mark covers Romania only; an EU trade mark covers the whole Union as one right, stands or falls as a whole and can be converted into national applications. Six months' priority from a first filing in a Paris Convention or WTO state lets one route follow the other. The choice is yours.

How do I check whether a name is already a registered trade mark in Romania?

Search OSIM's free online register, TMview and WIPO Madrid Monitor; OSIM's paid documentary search is informative only. Check the trade register for company names too, because a registered company name is a separate right. Whether a result is a real conflict is an opinion for an industrial property attorney or a Romanian lawyer.

Can someone oppose my trade mark, and what happens then?

Yes. Anyone with an earlier right may oppose within 2 months of OSIM publishing the admission; the fee is 305 lei or EUR 60 for one class. The parties then have 2 months to settle, extendable by up to 3 months, followed by evidence, a reply and a decision within 2 months. The EUIPO window is 3 months.

How long does a Romanian trade mark last, and what if I miss the renewal?

Ten years from the filing date, renewable for further 10-year periods. Renewal can be requested from 6 months before expiry, or within 6 months after it with the renewal fee raised by 50%. OSIM sends a reminder, but it carries no liability if the reminder never arrives, so the date has to sit in your own calendar.

Do I have to use the mark to keep it?

Yes. A Romanian mark not genuinely used in Romania for 5 uninterrupted years after the registration procedure ends, without good reason, can be revoked on request. An EU trade mark needs genuine use in the Union within 5 years of registration (EUTMR art. 18). The 5-year term is one of the dates we track with the renewal.

What happens to the trade mark when I sell my Romanian company?

If the mark itself is sold, the assignment needs a written deed signed by both parties, recorded at OSIM for 508 lei or EUR 100 and binding on third parties from publication. If the owning company is sold by its shares, it remains the owner; a lawyer confirms that reading for your transaction.

Is there EU funding for registering a trade mark in 2026?

Not from the EUIPO SME Fund: its 2026 trade mark voucher is exhausted. EUIPO fees carry no VAT and are not refunded if the application is rejected, so the EUR 850 online fee for one class is spent whatever the outcome. OSIM's national fees are listed above, itemised in lei and euro.
